However, before receiving baptism, it would be necessary that the catechumen's marriage situation be resolved (e.g., obtaining a declaration of nullity) so that the person be properly disposed and able to celebrate the sacraments of initiation. The Code does not overly restrict access to the eucharist. The Catholic party must declare that he or she is prepared to remove dangers of falling away from the faith and make a sincere promise to do all in his or her power to have all children baptized and brought up in the Catholic Church. In my quest to serve the parishioners, my bosses (priests), deacons, seminarians, and the Sisters in our Convent, I decided to buy this book. It provides simple explanations for complex questions and situations so that I am able to at least direct people to the right place or help them formulate the questions they need to ask a priest or deacon. I think it's a great book for any of those religious listed above as well, for quick reference when dealing with the most common situations: marriage and annulment, baptisms, adult confirmation. And provides a way to teach these concepts to people going through RCIA. I let everyone use this copy, I might have to splurge on an extra copy. However, there are many people who work in a parish who are not conversant in this mysterious subject, but are surrounded by people, things, and circumstances which pose questions that can only be answered by Canon Law. Although each diocese provides guidelines for many things like requirements for baptism and confirmation, or who can and who cannot be sponsors for these sacraments, sometimes things get a bit more complicated and when the pastor or priest is not around and the staff does not always know where to find those answers. There are the perennial issues like: when a dispensation or special permission must be obtained to perform a wedding. Going to the actual This is a great tool to keep close by in any parish office.http://www.asi-filter.pl/files/bureau-of-reclamation-concrete-manual-pdf.xml It is written by a Canon Lawyer for everyday people. Its Table of Contents provides easy entry to the subject for which you are looking for answers. It offers information primarily on the seven Sacraments, but also on parishes, the diocese, annulments, property and things like the obligations and rights of all Catholics. It makes a good textbook for a class. It is a welcome addition to anyone's library who just wants to know more about how the Church administrates itself. Not enough information. This book just might be better than the text books they give Seminarians as things are explained in such a way that they can understand those Canons they would have to deal with at the parish. It is easy to read. It is well organized. People in pastoral ministry will find the book very useful. This Guide was a very useful reference tool to ensure we were within Canon Law in what we were revising and reviewing. We completed in short time what at the onset we thought would take forever and this guide was part of the reason why the timeline was shortened.Easy to read and understand. While it is a quick and easy reference guide, some study and understanding of Canon Law would also benefit when handling more intricately delicate situations, concerns, or questions. Otherwise, consult your pastor if in doubt. However, it is a good read, if only to gain some insight to the machinations of the Church through what is outlined in Canon Law - all based on Scripture.Suitable for deacon study or lay reader. The entries are appropriately organized, the first giving an historic foundation for and a general orientation to canon law to help the pastoral minister realize that it is founded upon theological and historical sources. He proceeds with general canonical principles concerning the sacraments before presenting each one specifically. Parishes, the diocesan church, declarations of invalidity (annulments), temporal goods and rights in the Church then follow. Each section is briefly introduced by paraphrasing the canons which introduce these topics in the Code. A glossary of terms and suggested readings complete the text. For someone not versed in canon law, it is easy to read and should prove useful and beneficial. The glossary, with its definition of bold faced terms throughout the text is an especially helpful feature. While it is certainly up-to-date, there are some lacunae which would be helpful to correct in a text of this genre. When the A. discusses Mass offerings on p. 43, there is no reference to the February 1991 decree by the Congregation of the Clergy, Mos iugiter, allowing for several Mass offerings to be accepted as a collective intention for a single Mass. That's why successful organizations always create employee handbooks and clear procedure manuals that delineate where authority lies, how conflicts are to be resolved, and, above all, how each organization's mission is (and is not) to be accomplished. Is it any wonder then that the Catholic Church—comprised not of 200 persons but 1.2 billion members in 200 countries—also governs itself by means of a handbook, which it calls the Code of Canon Law. Because handbooks and manuals concern themselves with the day-to-day inner working of organizations, they often reveal more than do news releases about the actual purposes and genuine spirit of organizations: a fact that's particularly true in the case of the Catholic Church. Indeed, if you want to know the Church for who She is, you need to be familiar with the Code of Canon Law. Unfortunately, it contains over 1,752 rules (or canons). Among them, you'll find fascinating canons that lay out the Church's official principles and procedures governing matters as various as abbots and annulments, scandals and Sacraments, monks and missions, bishops and books, priests and popes, synods and sacraments, homeschoolers, hostile witnesses, baptisms, burials, parishes, penance, confessions, Councils, impotence, imprimaturs, and, even marriages to the person who murdered your spouse. Thankfully, Vatican expert and veteran author Fr. Laurence Spiteri has in the pages of Canon Law Explained relieved you of the need to read all 1,752 of them (fascinating or not). Spiteri transforms what seem to be dry-as-dust rules into the sweet waters of salvation. If you want to know the Church for who She is—and to love Her more—Canon Law Explained is the book for you. I let everyone use this copy, I might have to splurge on an extra copy. For an overview of the history and system of Catholic canon law, see Canon law of the Catholic Church. Edson Luiz Sampel, a Brazilian expert in canon law, says that canon law is contained in the genesis of various institutes of civil law, such as the law in continental Europe and Latin American countries. They do not constitute the law as such, but rather point out where it may be found. You can help by adding to it. ( August 2018 ) As a fact, it is simply the frequent and free repetition of acts concerning the same thing; as a law, it is the result and consequence of that fact.Custom in canon law is not simply created by the people through their constant performance of a certain act, but it is the constant performance of a certain act with the intention of making a custom, which is approved by the competent legislator, thereby acquiring the force of law.In the usage of the canon law of the Catholic Church, it has various meanings. Any papal Bull, Brief, or Motu Proprio is a decree inasmuch as these documents are legislative acts of the Pope. Each ecclesiastical province, and also each diocese, may issue decrees in their periodical synods within their sphere of authority. Its validity is based on its issuance by the pope by his own initiative, not upon the reasons alleged. The use of the term constitution comes from Latin constitutio, which referred to any important law issued by the Roman emperor, and is retained in church documents because of the inheritance that canon law received from Roman law.Generic constitutions use the title apostolic constitution, and treat on solemn matters of the church, such as the promulgation of laws or definitive teachings. The forms dogmatic constitution and pastoral constitution are titles sometimes used to be more descriptive as to the document's purpose. Apostolic constitutions are issued as papal bulls because of their solemn, public form. Some of what is included in the term ius would be interpretations of particular scriptural passages, theological understandings of the liturgy and liturgical practices themselves. Evidence for the content of this oral tradition of teaching is found among the writings of the Early Church Fathers as well as in the later legislation of the Church or lex.The Early Church, which existed more or less under persecution in the Roman Empire prior to Constantine I in the early fourth century, was not in a position to gather large councils for the purpose of legislation or theological clarification prior to 325 AD. This is usually not the case. Most Church legislation is either a development of prior teaching, or practice or re-affirmation of teaching or practice, unless otherwise expressly stated. In the Canon Law of the Catholic Church, lex refers to law which has been formulated in written form and promulgated by competent authority. The power of dispensing lies with the original lawgiver, with his successors or with his superiors, and with those persons to whom they have delegated this right. Such a dispensation is not, strictly speaking, legislative, but rather a judicial, quasi-judicial or executive act. It is also, of course, subject to the proviso that his jurisdiction to dispense with laws was limited to those laws which were within his jurisdiction or competence. Since there is no superior above the pope, he can therefore dispense from all canonical laws: universal laws introduced by himself, his predecessors or general councils, and particular laws enacted by plenary and provincial councils, bishops and similar prelates. In doubtful cases, however, he may decide authoritatively as to the objective value of the doubt.Matrimonial dispensations can be either to allow a marriage in the first place, or to dissolve one. It may be granted: (a) in favour of a contemplated marriage or to legitimize one already contracted; (b) in secret cases, or in public cases, or in both; (c) in foro interno only, or in foro externo (the latter includes also the former). Power of dispensing in foro interno is not always restricted to secret cases ( casus occulti ). These expressions are by no means identical. When a matrimonial impediment is common to both parties the bishop, in dispensing his own subject, dispenses also the other. He may also, under certain conditions, dispense from diriment impediments. You can help by adding to it. ( August 2018 ) This manifestation is the promulgation of the law, which is not necessarily distinct from the very elaboration of the law, provided that this takes place by external acts. This term is of wide application in canon law. Grants, laws, contracts, sentences, jurisdiction, appointments are at times revoked by the grantor, his successor or superior according to the prescriptions of law. Revocation without just cause is illicit, though often valid. Laws and customs are revoked when, owing to change of circumstances, they cease to be just and reasonable. Concordats (q.v.) are revocable when they redound to the serious injury of the Church. Minors and ecclesiastical institutions may have sentences in certain civil trials set aside (Restitutio in integrum). Contracts by which ecclesiastical property is alienated are sometimes rescindable. A judge may revoke his own interlocutory sentence but not a definitive judicial sentence. Many appointments are revocable at will; others require a judicial trial or other formalities. An authentic interpretation is an official interpretation of a statute issued by the statute's legislator. An authentic interpretation has the force of law.The words of a law must be understood according to their usual signification, unless it is certain that the legislator intended them to be taken in another sense, or the rules of law dictate another interpretation. In all interpretations, however, the meaning of the words is to be preferred which favours equity rather than strict justice. The provisions of a previous statute are not presumed to be changed beyond the express meaning of the words of a new law. No words of a law are ever presumed to be superfluous. In interpreting a law the words must be considered in their context. When the words of a law are doubtful the presumption is in favour of the subjects, not of the lawgiver.Derogation differs from dispensation in that it affects everyone, whereas dispensation applies to specific people affected by the law.Obrogation should not be confused with abrogation, which is the explicit repeal of a law, in whole or in part.New York: Paulist Press, 2000.
